Oral-Ship Construction, Stability, Ship Safety and Environment Protection (FUNCTION –3)

  • It is the international employment convention adopted by the ILO in February 2006
  • It is the fourth pillar for shipping, alongside SOLAS, STCW & MARPOL
  • It provides a global standard for seafarer’s rights to decent conditions of work, safe & secure workplace & fair terms of employment
  • It aims to ensure the protection of the rights of seafarers

MLC applies to ship, ship owner & seafarer.

It applies to all ships irrespective of tonnage

& does not applies to

Ships navigating in inland water, sheltered waters or areas where port regulation apply.

Those are: Fishing vessels

                    Traditional ships such as dhows & junks

                    Warships

                    Non-propelled offshore resource

Flag state administration has assigned the inspection and certification function to a Recognised Organisation (ROs) under a separate written agreement.

Ships of 500 GRT or over, engaged in international voyage.

a) What does DMLC means?

Declaration of Maritime Labour Compliance

DMLC means the declaration of compliance of maritime Labour convention.

b) DMLC Part-1

  • It is a document which identifies the topic for inspection.
  • It list the ship specific requirement under the legislation of MLC 2006.
  • This form is filled by the attending surveyor.

c) DMLC Part-2

  • It outlines what ship owner needs to do to meet the requirement.
  • It is filled by the ship owner.
  • The surveyor confirms its compliance when initial inspection is undertaken.

Title 1: Minimum requirements for seafarers to work on a ship

  • Minimum age

Title 2: Condition of employment

  • Seafarer employment agreement

Title 5: Compliance and enforcement

Abandonment occurs when ship owner fails to fulfill certain fundamental obligation of seafarer like salary, timely repatriation, basic necessities of life, adequate food, accommodation and medical care.

As per Reg. 2.2 – wages of MLC

Each member shall require that payments are made at no greater then monthly interval.
